What will the Panel Achieve?
The Panel will provide a range of benefits, including:
- improved quality, consistency and efficiency of purchasing Management Advisory Services with standard terms and conditions and a Performance Management Framework;
- cost savings and efficiencies for Service Providers by reducing administration and tendering efforts;
- reduction in the time and effort for Agencies and for Service Providers to establish contracts;
- replacing multiple panel arrangements across Government with a single panel arrangement; and
- providing standardised fee structures for Agencies, noting that a Service Provider’s fees across current panels can vary significantly for the same types of Services.

Transitioning to the new panel
As a coordinated procurement, in accordance with paragraph 4.12 of the Commonwealth Procurement Rules (CPRs), the Panel will be mandatory for use by non-corporate Commonwealth entities that are subject to the Public Governance, Performance and Accountability Act 2013 (PGPA Act).
Corporate Commonwealth entities and Commonwealth companies are also able to use the Panel, by entering into a Deed of Participation with Finance.
To enable compliance with the mandatory requirement for use of this Panel, Finance will provide Agencies with notification of the Services Commencement Date for each Phase of the Panel.
To maintain continuity of services, orders entered into prior to the Services Commencement Date for a Phase, may be completed. However, no long term contracts, or contracts with multiple extension options should be entered into.
Other Panels
There are more than 20 panels where some, or all, of their scope of services may be replaced by the Management Advisory Services Panel (the Panel). Finance has consulted with the managers of these panels to review these panels' scope of services, and to discuss transition matters.
Any other non-corporate Commonwealth entities (NCCEs) managing panels, that may be in scope of the Panel and have not consulted with Finance, should inform Finance’s Procurement Management Branch at WoAGProcurement@finance.gov.au and:
- must ensure that they familiarise themselves with the Scope of Services for the Panel
- determine to what extent, if any, their panel services are impacted by the Panel; and
- in line with the phased implementation of services under the Panel, put in place arrangements to cease using panel services that are impacted by the Panel.
Each entity will need to determine, and seek its own legal advice, on the most appropriate method to restructure, or terminate existing panels that are impacted by the Panel.
Extending current arrangements and new approaches to market
Once Management Advisory Services are available through the Panel it will be mandatory for NCCEs to use the Panel, except for Services engaged under the Flexibility Framework.
To maintain continuity of services, existing contracts that contain Management Advisory Services, such as those which will be available under the Panel, may be extended until the commencement of the relevant phase of the Panel.
Contracts entered into prior to each phase’s Services Commencement Date may be completed. However, no longer-term contracts, or contracts with multiple extension options should be entered into, in anticipation of the Panel Phase Service Commencement Dates.
The Panel Scope of Services will expand as each phase of the procurement is completed. Finance will notify Agencies of the Services Commencement Date for each phase.
The 360 Tender System?
The 360 Tender System is an online tender system, developed and supported in Australia by simplylogical.net. Finance will use this system to receive tenders in response to the RFT for future procurements including Panel refreshes.
The 360 Tender System comprises a 360 Providers’ Portal, which is a secure system hosted and supported in Australia which allows respondents to complete and submit their tender.
Potential Respondents are encouraged to access the 360 Tender System and register a new account (if you don’t already have one) at https://360providers.apetsoftware.com.au/.
Out of Scope services
The Services available under the Panel do not include:
- contractor (non-consultancy) services performed under the supervision of an Agency (except where this is an Associated Output identified prior to entering into a contract);
- recruitment or labour hire services;
- services available under other WoAG arrangements such as legal services;
- services that are unique to information and communication technology, and property consultancy services;
- environmental management and assessments;
- delivery of training;
- the engagement of an eminent person or prominent individual appointed by an Agency to provide particular services; and
- specialist consultancy services that are unique to Agencies that are not provided through the Service Categories.
Industry Consultation
Finance issued an Industry Consultation Paper on AusTender inviting industry feedback on the proposed approach to the procurement, the draft Head Agreement and the draft scope of services. A summary of Finance’s response to the industry feedback was published on AusTender on 27 October 2020.
