PGPA Rule amendments and Changes to the Flipchart
A new Flipchart and List of PGPA Act Commonwealth entities and companies was issued on 15 November 2022. The updates to both the Flipchart and the List reflect recent amendments to current Commonwealth entities and companies for the Public Governance, Performance and Accountability Act 2013 (PGPA Act).
PGPA Rule amendment, Domestic, Family and Sexual Violence Commission
The Finance Minister has approved an amendment to the PGPA Rule to reflect the Government’s decision to establish the Domestic, Family and Sexual Violence Commission (DFSV Commission) as a new non-corporate Commonwealth entity in the Social Services portfolio. The Public Governance, Performance and Accountability Amendment (Domestic, Family and Sexual Violence Commission) Rules 2022 amend Schedule 1 of the PGPA Rule to insert a new clause effective on 1 November 2022, prescribing the DFSV Commission as a listed entity for the PGPA Act including setting out its purposes for the finance law.
The DFSV Commission will provide strategic advice to the responsible Minister, develop and maintain a supportive approach to engagement with victim-survivors, enhance the coordination between public, private and not-for-profit sectors, and promote consistent approaches to monitoring and evaluation of the National Plan to End Violence against Women and Children 2022-32.
Northern Territory Aboriginal Investment Corporation
On 13 December 2021 the previous Parliament passed the Aboriginal Land Rights (Northern Territory) Amendment (Economic Empowerment) Act 2021 (the Act) to establish the Northern Territory Aboriginal Investment Corporation (NTAI Corporation). The new corporate Commonwealth entity commenced in the Prime Minister and Cabinet portfolio, following Proclamation of Schedule 1, Part 1 of the Act by the Governor-General on 15 November 2022.
The NTAI Corporation will be responsible for promoting the self-management, economic self-sufficiency and social and cultural wellbeing of Aboriginal people living in the Northern Territory.
Financial Adviser Standards and Ethics Authority Ltd
On 10 September 2022, the Australian Securities and Investments Commission (ASIC) deregistered the Financial Adviser Standards and Ethics Authority Ltd (FASEA) as a company which means, FASEA also ceased as a Commonwealth company for the PGPA Act. The Financial Sector Reform (Hayne Royal Commission Response – Better Advice) Act 2021, divided FASEA’s functions between the Department of the Treasury and the Financial Services and Credit Panel within ASIC. This implements recommendations from the Royal Commission into Misconduct in the Banking, Superannuation and Financial Services Industry to establish a new single disciplinary body for financial advisers.

Performance Community of Practice Sessions – registrations closing soon!
Performance Community of Practice (CoP) sessions will be held on 21 November and 23 November at the Department of Finance, One Canberra Avenue, Forrest. The CoPs will be held in Finance’s conference facilities from 10.00am to 11.30am on both days. Note that these sessions are the same.
These sessions will provide an update on activity that has occurred since the last CoP sessions held in October/November 2019, including:
- the amendment to the PGPA Rule in respect to corporate plans
- the amendment to the Finance Secretary’s Direction in respect to Portfolio Budget Statements
- assurance audits of annual performance statements
- annual reports, the Digital Annual Report Tool and the Transparency Portal
- digitising information about PGPA entities and companies
- updates to Resource Management Guides
- the Evaluation Policy and Toolkit (RMG-130).

This new RMG, found here, has been published using the digital first approach.
The guide
- provides advice on how relevant property should be disposed of
- provides guidance on when it may be appropriate to gift relevant property
- outlines the procedures that must be followed before relevant property can be gifted.

Refreshed RMG-402 Payment of an amount owed to a person at time of death
The guidance has been enhanced to align with the digital approach to our guidance and focuses on the discretionary power, under section 25 of the PGPA Rule, for the Finance Minister to authorise the payment of an amount if, at the time of a person’s death, the Commonwealth owed that amount to the person. This guidance has been enhanced only, no other changes have been made to the content.
